For some months now, Amazon has been asking sellers to provide a certificate of compliance for the sale of food supplements in the European Union This certificate must be issued by a third-party company specializing in this field and attest to the product's compliance with the applicable regulations and standards. It must be sent with images of the products that have been evaluated.

This new requirement from Amazon is part of a desire to improve transparency and consumer safety. It is therefore with a view to quality and not to complicate the marketing of products that the platform has updated its obligations.

Compliance of food supplements in Europe

In the European Union, food supplements are regulated by the Framework Directive 2002/46/EC. It sets out the definitions, basic principles on food supplements, product safety, etc. In particular, it details in a positive list, the nutrients (vitamins and minerals) authorized in food supplements sold on European territory.

Moreover, food supplements are also impacted by the Regulation (EC) 1924/2006, on nutrition and health claims, as well as by the so-called INCO Regulation (EU 1169/2011) which sets out the general principles and requirements for all matters relating to foodstuff labelling.

Finally, it is important to note that, as these products are governed by a European directive, the obligations may vary from one Member State to another. Indeed, a directive, unlike a regulation, is not directly applicable and must be transposed into the national legislation of each country. Thus, there are variations within the EU itself in terms of notification requirements, the cost of notification, the levels of authorized nutrients and the composition of the supplements themselves.
